Taking An Additional Or A Reduced Amount Of One Commodity (Merchandise) Is Usury

Humaid Ibn Qays al-Makki: One Hadith

[153] From Malik from Humaid Ibn Qays al-Makki that Mujahid (Ibn Jubair the Tabi’i) said, I was with Abdullah ibn Umar (Radi Allahu Anhu) and a Goldsmith came to him and said, ‘O Abu Abd ar-Rahman – I make jewelery using Gold and then sell what I have made for more than its weight. I take an amount equivalent to the work of my hand.’ So Abdullah Ibn Umar (Radi Allahu Anhu) forbade him to do that, so the Goldsmith repeated the question to him, and Abdullah (Radi Allahu Anhu) continued to forbid him until he came to the door of the Masjid or to his riding animal (i.e. vehicle) that he intended to mount. Then Abdullah ibn Umar (Radi Allahu Anhu) said, ‘A dinar for a dinar, and a dirham for a dirham. There is no increase between them. This is the command and advice of our Prophet (Sallalahu Alayhi Wa Sallam) to us and our advice to you.’

Al-Muwatta (Yahya’s narration (2/633, hadith no.1362, book 31, chapter 16, hadith no.31), at-Tamhid (2/242) and al-Istidhkar (no.1282)

Transmitted by Imam ash-Shafi’i in ar-Risalah (pg no.277 hadith no.760) from the hadith of Malik in a summarised form and there is another summarised version of this hadith also in an-Nasa’i (7/278 hadith no.4572)!

[UNDERSTANDING FROM THE HADITH]
1) If the merchandise goods used in the transaction are of the same type then it is not allowed to give a higher amount of it for a lower amount and vice versa. The Goldsmith (or Jeweler) should mention the value / price of the Gold (or merchandise) in weight separately.

2) Every persons’ opinion is rejected in comparison to the hadith.

3) The people of Iman should be willing to call towards following the Quran and Sunnah all the time (and in all situations) whether the people are pleased or not pleased (in hearing it).

4) Ibn Umar (Radi Allahu Anhu) had an immensely great established position when it came to following the Sunnah and was continuing to follow the straight path.

5) The Sahih hadith is a proof even if it is a Khabar Wahid (Lone report).

6) Interest is haram. The Islamic Shari’a has closed all the doors of interest by declaring it to be haram.

7) In explanation to this hadith Ibn Abdul Bar refutes an incorrect statement / opinion by writing that, “These kind of statements (or opinions) which are prevalent between people have only come about and entered (into their know-how) because of Taqlid. This is because if a scholar mentions something in front of a person who does not look into matters with detail, he ends up writing it down and turns it into the religion and without even looking at the evidences he starts refuting his opposition and thus becomes a victim of error and only Allah is the one who provides success.” (at-Tamhid vol no.2 pg no.248)
